The petitioner had appeared in the NEET - MDS 2024 and participated in the four rounds of counseling that took place. She has come to know that after all the rounds of counseling, one seat remained vacant in the respondent no. 11 / college. She prays for a direction either to take admission in that seat or to allow that seat to be declared as vacant for others to participate in another round of counseling that may be allowed. Learned counsel appearing on behalf of the Indian Dental Council denies the allegations and submits that 25.10.2024 was
the last date for joining in the MDS course. The petitioner could not get success any of the round of counseling. Therefore, she cannot ask for admission in the said seat even if the same remained vacant.
Learned counsel appearing on behalf of the College submits a seat, in fact, remain vacant for the MDS course. Learned counsel for the Counseling Committee denies the allegations and submits as follows. It is quite evident that 25.10.2024 was the last date for joining. Unlike in some other branches, the date of counseling has not been extended for the MDS course. Therefore, there is no scope either for allowing the petitioner to take admission in the said seat even if the same seat is remained vacant or to allow any further round of counseling.
It appears that the petitioner was not successful in any of the four rounds of counseling in the MDS Course. Even if, for some reason, it is found out that one seat has remained vacant, it is not for the petitioner to claim any special right to get admission in that seat.
No direction has been passed to extend the date for counseling or admission.
In view of the above discussions, I do not find any merit in this application and the same is accordingly dismissed. However, there shall be no order as to costs. Parties shall act on a server copy downloaded from the official website of this Court.
