Learned advocate appearing for the petitioner submits that the petitioner is in custody for 14 months 14 days and only three witnesses have been examined, out of nine witnesses which the prosecution intends to examine. Learned advocate further submits that one of the seizure list witness has turned hostile. As such, petitioner may be released on bail on any stringent condition.

Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that other witnesses are being examined. As such, release of the petitioner may jeopardize the trial of the case.

Having considered the quantum of recovery of heroin in this case, I am not inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is rejected. Prosecution is directed to examine the other seizure list witnesses within a period of 45 days from the next date so fixed.

Petitioner will renew his prayer for bail after the examination of the other seizure list witnesses is over. The application for bail, being CRM (NDPS) 1518 of 2025, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
