Mr. Sandip Das ...for the Petitioners. This is an application wherein petitioners have prayed for expeditious disposal of injunction application as well as suit being Title Suit No. 153 of 2015 presently pending before learned Civil Judge (Junior Division), Kakdwip.

Petitioners contended that the plaintiff along with the suit have also filed an application for injunction and the petitioner/defendant has already filed a written objection against that injunction application on 30th July, 2015 but since then the application is pending for disposal. Accordingly, they prayed for a direction upon the court below for expeditious disposal of the injunction application as well as the suit.

Since the prayer made on behalf of the petitioners is innocuous and if any order is passed in terms of aforesaid prayer made by the petitioners, opposite parties will have no cause to prejudice, the service of copy of application along with notice upon the opposite parties are dispensed with.

Having heard learned counsel appearing on behalf of the petitioners and that the injunction application is pending since 30th July 2015 causing exorbitant delay, I find that the prayer made on behalf of the petitioners in the application is justified and is required to be allowed for the ends of justice.

C.O. 3932 of 2024 is hereby disposed of with a direction upon the court below to dispose of the injunction application within a period of eight weeks from date and to make every endeavour for expeditious disposal of the aforesaid suit and to make his best effort to conclude the entire proceeding preferably within a period of six months from the date of disposal of injunction application without granting any unnecessary adjournment to either of the parties.

Urgent Photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities.
