1. The learned advocate appearing for the petitioner submits that the instant writ petition had been filed upon being aggrieved by the inaction on the part of respondent No. 3 in concluding the proceedings in respect of resumption of operation and settlement of license of a Foreign Liquor OFF Shop run under the name and style of M/s Diner Shese. It is further submitted that during pendency of this writ petition, the proceedings have been concluded and the respondent No. 3 has passed an order dated January 17, 2025. It has been submitted that in view thereof, the writ petition has become infructuous.

2. Mr. Tanoy Chakraborty, learned advocate appearing for the State respondents concurs with the submission of the writ petitioner and submits that the writ petitioner has assailed the order dated January 17, 2025 passed

by the respondent No. 3 before the Special Excise Commissioner in appeal.

3. Since the cause of action for which the writ petition was filed no longer survives, therefore, the writ petition is dismissed as having become infructuous.

4. The copy of the order dated January 17, 2025 and the communication dated March 21, 2025 handed up by the learned advocate appearing for the State be taken on record.
