APP Ms. Nahid Ahmed ... for the State-respondent(s) Ms. Sharmistha Ghosh Mr. Amit Ghosh ... for the IOCL Mr. Mukherjee, learned Senior Advocate, appearing for the petitioner submits that the petitioner is in custody since 18th June, 2025 and has been implicated in the Supplementary Charge-sheet. It has also been submitted that the petitioner was supplier of the tankers through which allegedly pilfered oil was removed.
Learned Advocate for the State, on the other hand, opposes the prayer for bail and submits that there was a lease agreement in respect of the land through which
pilferage took place. Learned advocate also states that the petitioner is a resident of Gujarat.
I have taken into account the accusations so far as the present petitioner is concerned and the evidence which has been collected. The evidence against the present petitioner, even if accepted to be true, he cannot be considered to be the main beneficiary of the acts and activities which is being carried out.
Further, I find that the learned Judicial Magistrate who recorded the statement of the present petitioner has not been made a witness in the charge-sheet.
Additionally, it has been submitted that, on the one hand, the investigation of the case is still proceeding and the trial of the case is continuing on the other hand. Having considered the submissions advanced by the State, I am of the view that further incarceration of the present petitioner is unwarranted.
Hence, the prayer for bail of the petitioner is Allowed.
Accordingly, the petitioner viz, Krunal Girish Bhai Patel shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the CJM, Purba Bardhaman.
If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned trial court and shall not leave the district of Purba Bardhaman without prior intimation to the learned trial court.
Accordingly, CRM(M) 2492 of 2025 is allowed.
