Mr. Suman Sengupta who usually appears for the State and is present in Court, is requested to represent the State in the matter. His appointment be regularized by the appropriate authority.

The petitioner is directed to serve copy of the writ petition along with annexure thereto upon Mr. Sengupta in course of this day.

The sole grievance of the petitioner is that private respondent nos.10 & 11 have installed CCTV camera in their premises adjacent to that of the petitioner which covers the bed room of the petitioner, thereby infringing her privacy.

The petitioner seeks reinstallation of the CCTV camera in a manner so as not to cover her bed room. It appears from the report submitted by the State that there are disputes between the petitioner and the private respondent nos.10 & 11 and pursuant to the complaint lodged by the petitioner spot enquiry was held by the police. It was found that the private respondents have installed a CCTV camera in order to protect their vehicle which was damaged by unknown miscreants on several occasions. According to the police, the camera does not face the bed room of the petitioner and only covers a nominal part of the petitioner's outer premises. As such, no violation of the petitioner's right to privacy was found. However, the petitioner still insists that her bed room falls within the purview of that CCTV coverage. Since it prima facie appears from the report submitted by the State that the CCTV camera covers only a nominal part of the petitioner's outer premises and not any part of her bed room, no relief can be granted to the petitioner in the present application.

Nevertheless, in the event the petitioner seeks to substantiate her allegations by adducing evidence she is at liberty to approach the appropriate forum for redressal of her grievance.

The writ petition is devoid of any merit and is accordingly dismissed.

There shall, however, be no order as to costs.

Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
