Affidavit of service filed by the petitioners in Court today is taken on record.

Being aggrieved by the order dated 20th August, 2019 passed by the Commissioner of School Education, the petitioners filed representation before the said respondent in October, 2025.

Allegation is that the same has not been considered till date.

Learned advocate representing the State respondents opposes the submission and prayer of the petitioners.

It has been submitted that the representation has been filed after considerable delay and no direction ought to be passed for consideration of the same.

Upon hearing the submissions made on behalf of both the parties, it appears that the petitioners applied before the Commissioner of School

Education in October, 2020 praying for certain service benefit.

Accordingly, without entering into the merit of the claim of the petitioners at this stage, the instant writ petition stands disposed of by directing the Commissioner of School Education, West Bengal, to consider the representation filed by the petitioners on 14th October, 2020 along with the representation dated 21st October, 2025 in accordance with the prevailing Rules at the earliest but positively within a period of twelve weeks from the date of communication of this order.

A reasoned order shall be passed and communicated to the petitioners immediately thereafter.

It is made clear that this Court has not entered into the merits of the prayer of the petitioners and it is open for the Commissioner of School Education to take a decision in the matter in accordance with law.

Learned advocate for the petitioners is directed to forward a copy of the impugned order dated 20th August, along with copy of the representations dated 14th October, 2020 and 21st October, 2025 to the aforesaid respondent at the time of communication of the order of the Court.

The writ petition stands disposed of.

All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
