Mr. Mitra, learned counsel appearing for the petitioner submits that since certain documents which are imperative for consideration of this matter have been erroneously omitted, leave may be granted to him to withdraw the writ petition.

2. In view of the afore-stated submission, the petitioner is permitted to withdraw the writ petition and liberty is granted to file afresh on the self-same cause of action.

It is made clear that the point of maintainability raised by the respondents, has not been addressed by this Court.
