1. In view of the recovery of the missing child during the pendency of the habeas corpus petition, no further order can be passed in this proceeding.

2. We dispose of this habeas corpus petition on the basis of the submissions made on behalf of the parties as well as on the basis of the report filed by the Officer-in-Charge, Kalna, Purba Bardhaman that both the parents of the VGs have taken custody of the child on the basis of the order passed by the learned ACJM, Kalna in PS Case No.957/23 dated 28th August, 2023.

3. The report filed by the Officer-in-Charge is taken on record.

4. Accordingly, WPA (H) 79 of 2023 stands disposed of.

5. However, there shall be no order as to costs.

6. Urgent Photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
