Learned counsel appearing on behalf of the petitioner submits as follows. The private respondents had taken a loan of Rs.4 lakhs from the petitioner, but did not repay the same. Complaint was made to the police authorities, but no FIR was registered.

In the event the petitioner still believes that a cognizable offence is made out, he shall be at liberty to act in terms of the ratio laid down in Aleque Padamsee's case, (2007) 6 SCC 171.

Therefore, no further order need be passed.

With these observations, WPA 25972 of 2023 is disposed of.
