Versus

Petitioner submits that inspite of the direction of the Civil Judge (Junior Division) 2nd Court, Baruipur, 24 Parganas South wherein in TS 307/21 by an order dated 01.09.2022 restraining any further illegal construction of the suit property, the same is being violated and is being carried out at the behest of the private respondent no. 6.

Petitioner would apply under the relevant provisions of law before the civil judge in seisin of TS 307/21. The civil court will consider in respect of the prayers for police assistance and if it is satisfied, would render specific directions upon the Inspectorin-Charge of the concerned police station. If such a direction is passed by the Civil Judge (Junior Division), 2nd Court, Baruipur who is in

seisin of TS 307/21 the Inspector-in-Charge, Basanti Police Station would respect and obey such order. As number of cases are pending between the parties, police authorities would keep a strict vigil and would ensure that no breach of peace takes place at the locale.

With the aforesaid observations WPA 27290 of 2024 is disposed of.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
