The petitioner submits that in terms of a Division Bench order of this Court dated January 11, 2023 passed in FMA 329 of 2022 with CAN 2 of 2022 (Bidhan Chandra Krishi Viswa-Vidyalaya & Ors. Vs. Dr. Pranab Kumar Bandopadhyay & Anr.), he was entitled to certain financial benefits for his reemployment at the university. It is the case of the petitioner that he has not been paid in full in terms of the aforesaid order. This writ petition has been filed pursuant to the liberty granted to the petitioner in contempt application, CPAN 126 of 2022 arising out of W.P.A. 6839 of 2021 (Dr. Pranab Kumar Bandopadhyay vs. Dr. Subhendu Bikash Goswami and Ors.).

Learned advocate appearing for the petitioner submits that the petitioner is inclined to make a representation to the Vice-Chancellor of the University

seeking the financial benefits as prayed for in this writ petition.

In that view of the matter, this writ petition is disposed of by granting liberty upon the petitioner to file a representation before the Vice-Chancellor, Bidhan Chandra Krishi Viswavidyalaya, within a period of three weeks from date.

If such representation is made, the ViceChancellor shall consider the same after giving an opportunity of hearing to the petitioner in accordance with law within one month thereafter. A reasoned decision should be communicated to the petitioner within one week thereafter.

Accordingly, WPA 25988 of 2023 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with the requisite formalities.
