Affidavit of service filed in Court today on behalf of the petitioner is taken on record.

Matter relates to sanction of post-graduate scale of pay in favour of the petitioner who was initially appointed as an Assistant Teacher in Mathematics on 16th September, 2009 and completed post-graduate course in Mathematics on 15th October, 2012 from Netaji Subhas Open University. Since petitioner has upgraded her educational qualification by acquiring post-graduate qualification in relevant subject of teaching, prayer is made for giving direction upon the concerned State respondents to sanction postgraduate scale of pay.

It is also submitted by learned advocate representing the petitioner that she has been enjoying Hons. scale of pay from the date of initial appointment on 16th September, 2009.

State respondents are represented by learned advocate who has submitted that since the school authority where the petitioner is presently working has forwarded the proposal for sanction of post-graduate scale of pay with the Managing Committee resolution, vide letter dated 18th July, 2018, as it appears from page 29 of the writ petition, the claim of the petitioner for sanction of post-graduate scale of pay be decided by the District Inspector of Schools (S.E.) Barasat, North 24-Parganas, being the respondent no.3, in accordance with law.

Having considered the submissions made on behalf of the parties, the writ petition stands disposed of directing the respondent no.3 to decide the claim of the petitioner for sanction of post-graduate scale of pay by 8 (eight) weeks from the date of communication of this order and a reasoned order shall be passed to that effect.

Before taking such decision, the respondent no.3 shall grant opportunity of hearing to the petitioner or her representative. The decision to be taken shall be

communicated to the petitioner by one week thereafter.

There will be no order as to costs.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
