Kausik (Rejected) CRM (NDPS) 1525 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Bhagwangola Police Station Case No. 393 of 2024, dated 2nd of August, 2024 under section 21(C)/29 of the NDPS Act, 1985;

Learned advocate appearing for the petitioner submits that 105 bottles of Phensedyl were recovered from the possession of the petitioner and the petitioner is in custody for 1 year and 3 months, investigation has been concluded and charge sheet has been submitted; charges have been framed on or about September, 2025 and dates have been fixed for evidence. Petitioner prays for bail on any stringent conditions. Learned advocate for the State, on the other hand, submits that there are suppression of material facts as against rejection of the order in CRM (NDPS) 355 of 2025. Petitioner preferred an application for appeal before the Hon'ble Supreme Court and the same has been dismissed in Special Leave to Appeal (Crl.) No(s). 10971 of 2025.

Having considered the suppression pointed out by the learned advocate appearing for the State, I am not inclined to release the petitioner on bail.

Accordingly, CRM (NDPS) 1525 of 2025 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
