Ganguly ...for the State 18-11-2024 AKG Ct. 15 The principal grievance of the petitioners is that the election of Goghata Samabay Krishi Unnayan Samity Ltd. has been scheduled on December 15, 2024 without the publication of draft voter's list and without giving any opportunity of hearing to the petitioner to raise their objection regarding the draft voter list. In view of the stance of the Co-operative Election Commission before this Court, there is no need to keep this writ petition pending.

The Election Commission submits that if the writ petitioners raise any objection with regard to the voter's list published on November 8, 2024, the Commission shall consider the same, and if necessary,

it shall publish a rectified voter's list.

In view of the aforesaid, I grant liberty upon the petitioners to make a representation before the Election Commission raising their objection with regard to the voter's list published on November 8, 2024 within 72 hours from date.

If such objection is filed, the Commission shall consider the same and make necessary rectification in the voter's list within 72 hours thereafter. The Commission shall hear the representative of the petitioners in deciding their objection. The petitioners must produce the supporting documents to substantiate their claims before the Commission. The dates of the election program, however, shall remain unchanged.

Accordingly, WPA 27264 of 2024 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
