Gupta ...for UGC 03-01-2024 AKG Ct. 238 It has been submitted by the learned advocate appearing for the petitioner that due to some personal difficulties of the learned advocate on record for the petitioner, no service could be effected upon the respondents in terms of the order dated December 6, 2023, passed in this writ petition.

I am, however, not inclined to keep this writ petition pending any further having regard to the facts involved in this case.

It is the grievance of the petitioner that he deposited Rs. 17,500/- before respondent no. 4 through respondent no. 6 to pursue an online course namely, Masters of Business Administration. Subsequently, it was found that the course had no approval from the University Grant Commission. The petitioner accordingly, prayed for refund of his admission fees by a letter dated December 19, 2018 from respondent no. 4. Despite such communication, no response was made by respondent

no. 4.

It, however, does not appear that the representation dated December 19, 2018 was received by respondent no. 4.

In that view of the matter, I dispose of this writ petition granting liberty upon the petitioner to file a fresh representation within three weeks from the date of communication of this order before respondent no. 6 seeking refund of said sum of Rs. 17,500/-. If such representation is made, respondent no. 4 shall consider the same in accordance with law. If it is found that the petitioner is entitled to get back his fees, respondent no. 4 shall refund the same within one month from the date of communication of this order. If the refund is declined, the reason for the same shall be communicated to the petitioner within fifteen days from the date of communication of this order.

Accordingly, WPA 26332 of 2018 is disposed of. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with the requisite formalities.
