Report submitted by the learned advocate appearing for the State be also kept with the record. A copy of the report be handed over to the learned advocates for the petitioners and the private respondents.
Learned advocate appearing for the petitioners is aggrieved by the fact that in spite of a restraint order being passed upon the private respondents in Title Suit No. 464 of 2021 by way of a temporary injunction, the private respondents are interfering in the free egress and ingress of the petitioners.
Learned advocate appearing for the private respondents submits that they are not disturbed because of the order passed by the civil court as they have no interest in the property referred to therein.
State has submitted a report which reflects that the police authorities on the basis of the complaint filed by the petitioners dated 07.11.2024 registered Burdwan Police Station Case No.
1182/2024 dated 18.11.2024.
In view of the petitioners' grievance being addressed, the police authorities are directed further to keep a strict vigil and to see that no breach of peace takes place at the subject property referred to in the writ petition.
With the aforesaid observations, the writ petition being WPA 27273 of 2024 is disposed of. There shall be no order as to costs.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
