Learned advocate appearing for the petitioner submits that petitioner is in custody for 1 year and 10 months and 11 witnesses out of 19 witnesses have been examined. There is no scope of tampering with the evidence, as such on any stringent condition the petitioner may be released on bail. Learned advocate for the State has produced the case diary.
I have considered the statement of the victim under section 164 of the Cr.P.C. as well as the medical documents which are appearing.
Learned advocate submits that in the deposition before the Court the evidence is otherwise. However, having regard to the documentary evidences which are available at this stage, I am not inclined to release the petitioner on bail. Learned Trial Court would expedite the process of trial. As such, CRM (M) 2502 of 2025 is dismissed.
Report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
