Learned advocate appearing for the petitioner submits that from the joint possession of the petitioner and another, 23 Kgs. of Ganja were recovered and the investigation have been completed. The petitioner may be released on bail on any stringent conditions.

Learned advocate for the State opposes the prayer for bail and submits that one of the accused person is still absconding.

Having considered the period of detention of the petitioner I am of the view that there is no scope of the trial completing very soon. Petitioner may be released on bail.

Petitioner, namely, Rabiul Sk. shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Judge, Special Court, under NDPS Act cum Additional District Judge, 5th Court, Berhampore, Murshidabad.

If on bail the petitioner shall be physically present on each and every date fixed by the learned Trial Court. Petitioner shall not leave the jurisdiction of District of Murshidabad without the permission of the learned Special Court. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
