Mr. Jayanta Kumar Das Ms. Madhumanti Das ... ... for the petitioners Mr. Jaharlal De Ms. Smita Das De ... ... for the State By this petition the petitioners who are residents of Village - Makarda, Post Officer - Akwageria, Police Station - Pingla, District - Paschim Medinipur have raised the grievance in respect of various irregularities and misappropriations, etc. done by the authorities of the Panchayet in the implementation of MGNREGA for the year 2014-15 and 2015-16.

As per the previous direction of this Court the enquiry report at the instance of Block Development Officer, Pingla, Paschim Medinipur has been submitted but learned counsel for the petitioners has disputed that report and has made a prayer that keeping in view the nature of allegation the enquiry ought to have been conducted by the respondent no.4, District Magistrate, Paschim Medinipur.

Learned counsel for the State has no objection to the same.

Hence, we dispose of the writ petition granting liberty to the petitioners to file a detailed comprehensive representation before the respondent no.4. On receipt of

the same, the respondent no.4 will conduct an enquiry, if required, and take an appropriate decision in accordance with law.

If any misappropriation, illegality or irregularity as alleged by the petitioners is found by the respondent no.4 then the action against the defaulting officers will be taken without any delay.

Let this exercise be completed within a period of three months from the date of receipt of the representation.
