No. 262 of 2020 arising out of Goghat Police Station Case No. 61 of 2020 dated 24.02.2020 under Sections 420/465/468/471/120B of the Indian Penal Code adding Sections 474/476 of the Indian Penal Code.

And In Re :

Sri Subhankar Kirtonia ... Petitioner.

Mr. Tanmay Chowdhury, Ms. Ritoprita Ghosh ... For the Petitioner.

Mr. Ranabir Roy Chowdhury, Mr. Mainak Gupta ... For the State.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for about 58 days and other accused persons who were arrested have been granted bail. Learned advocate submits that the petitioner has cooperated with the Investigating Officer of the case and his further detention is not required for the sake of investigation. Mr. Roy Chowdhury, learned advocate appearing for the State opposes the prayer for bail and submits that the petitioner is thickly connected with the offence. I have considered the materials appearing in the case diary and I find that the case is based on documents. Having regard to the fact that the petitioner is a permanent resident and he has already suffered custody for about 58 days, I am

inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is allowed.

Accordingly, the petitioner viz., Sri Subhankar Kirtonia shall be released on bail upon furnishing bond of Rs.10,000/- (Rupees Ten Thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Arambagh.

If on bail, the petitioner shall meet the Investigating Officer of the case once a week till submission of the chargesheet. The petitioner shall once in a fortnight attend the court of the learned Additional Chief Judicial Magistrate, Arambagh and obtain acknowledgement from the office of the said court.

If the petitioner intends to leave the district of Hooghly, in that case, the petitioner shall obtain permission from the learned Additional Chief Judicial Magistrate, Arambagh providing details of leaving the district of Hooghly. The application for bail, being CRM (SB) 285 of 2022, is, thus, disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
