Seeking restoration of the proceeding is considered. The explanation set out in the application is sufficient to recall the order dated 28.11.2014. Let the revisional application be restored to its original file and number.

The application being CAN 1 of 2014 is disposed of. Mr. Mukherjee submits that the revisional application challenges an order passed in O.C. 39 of 2009. As a matter of fact the suit has been disposed of, even appeal filed before this Court has been dismissed.

The petitioner has preferred a Special Leave Petition before the Hon'ble Apex Court which is pending. Accordingly the revisional application challenging the order passed in the suit has beome infructuous and is disposed of.
