....For the Respondents State Referring to page 18 to the writ petition Mr. Debasish Kundu, learned Advocate appearing for the petitioner submits that, at the PST level the PST Board has measured the height of the petitioner as 169 cm. whereas the cut off is 170 cm. The petitioner immediately preferred an appeal before the appellate authority when the appellate authority passed its order dated October 26, 2024 and rejected the candidature of the petitioner with a remark "less in height". Referring to Clause 2(d) of the Medical Guidelines, learned Advocate for the petitioner submits that, unless the appellate authority specifically mentions the measured height of the petitioner by it, the petitioner is not in a position to ascertain whether he can get the benefit of clause 2(d) of the Medical Guidelines. Learned Advocate for the petitioner has also relied upon an order passed by the Hon'ble Division Bench

dated August 19, 2025 in MAT 37 of 2025 in pursuance whereof this writ petition has been remanded back before this Court for further consideration. Learned Advocate Mr. Ram Chandra Agarwal appearing physically with Ms. Rashmi Bothra, learned Advocate appearing through virtual mode for the respondents/Union of India has opposed this writ petition on various counts. They shall place all the relevant orders and documents on the next day and accordingly learned Advocates for the respondents have prayed for some time.

In view of the above, the writ petition shall appear under the heading "Motion (Service)" on November 27, 2025.
