Learned advocate appearing for the petitioner submits petitioner is in custody for 2 years and 1 month and is innocent of the charges. There are earlier orders to complete the trial within a scheduled period of time. But there has been no efforts on the part of the prosecution to conclude the trial and only two witnesses out of 26 witnesses have been examined.
Learned advocate for the State opposes the prayer for bail and draws the attention of the Court to the seizure list which reflects regarding certain recovery from the house of the petitioner along with the leading statement of the petitioner. It has also been pointed out that the order dated 07.11.2025 of
the learned Sessions Court reflects that the delay in the present case are because of the accused persons and not of the prosecution.
Having considered the same and the fact that petitioner was also identified in the T.I. Parade, I am of the view that it would not be fit and proper to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner in CRM(M) 2506 of 2025 is dismissed.
