Mr. Tanmoy Chowdhury Ms. Ritoprita Ghosh ...for the Petitioner. This is an application wherein the petitioner has prayed for expeditious disposal of Title Suit no. 109 of 2009 pending before the learned Civil Judge (Junior Division), 2nd Court, Barrackpore, DistrictNorth 24 Parganas. It is submitted on behalf of the petitioner that though the argument on behalf of both the parties concluded on 20th December, 2023 but the Trial court has not yet delivered judgment and fixing dates one after another. It is further submitted that the next date is fixed on 7.2.2025 for further clarification and for further argument. Accordingly petitioner has prayed for a direction upon the court below for expeditious disposed of the case which is almost in the verge of completion.

Since the prayer made on behalf of the petitioner is innocuous and if the relief is granted in terms of the prayer made in the petition, neither party will have a cause to prejudice, the service of

copy of the Application and notice upon the opposite parties is dispensed with.

Having considered the facts and circumstances of the case and upon hearing the learned counsel appearing on behalf of the petitioner, the present application being C.O. 3946 of 2024 is hereby disposed of with a direction upon the court below to conclude the entire proceeding including delivery of judgement preferably within a period of sixty days from the next date of hearing i.e. 7.2.2025.

Urgent Photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities.
