Petitioner(s) Mr. Abhijit Singh Mr. Anisur Rahman ... for the Petitioner(s) Mr. Antarikhya Basu Ms. Diksha Ghosh ... for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner has been falsely implicated in connection with the instant case and as the place of seizure is questionable, the petitioner is entitled to get benefit of the same. Learned advocate also submits that as the investigation has already been completed, the petitioner may be released on bail. Learned advocate for the State, on the other hand, opposes the prayer for bail and submits that 2490 liters of codeine mixture were recovered.
Having considered the quantity of seizure effected, I am of the view that the rigors Section 37 of the NDPS Act is attracted, as such, I am not inclined to enlarge the petitioner on bail.
Hence, the prayer for bail of the petitioner is Rejected.
Accordingly, CRM(NDPS) 1520 of 2025 is dismissed. Since the petitioner is in custody for more than two years, the learned trial court would expedite the process of trial and ensure that all the seizure list witnesses are examined within a period of three months from the date of communication of this order.
The petitioner and the State would communicate server copy of this order to the learned trial court. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
