1. Affidavit-of-service filed in Court today be kept with the record.

2. The grievance of the petitioners is that the authorities of the State Bank of India, Jangipur Branch, are not releasing the gold ornaments under Safe Deposit Scheme vide SD No.12/30 dated 12.08.1971 in spite of the fact that the petitioners have complied with all requisite formalities in that regard.

3. Learned advocate representing the State Bank of India seeks leave to file vokalatnama.

4. Liberty is granted to learned advocate for the State Bank of India to file vokalatnama in the department in course of the day.

5. Learned advocate for the State Bank of India submits that the Safe Deposit Scheme stands in the name of one Upendranath Saha, since deceased. He submits that the claimants are

required to submit an application for settlement of claim; declaration/affidavit by the claimants and indemnity bond in respect of delivery of contents of the said scheme in the prescribed format. He submits that claimants have not complied with the requisite formalities. He further submits that the death certificate of the said Upendra nath Saha and one Manzu Hazra also to be submitted along with the said application and bank charges are also to be paid.

6. Mr. Chatterjee, learned advocate representing the petitioners submits that a copy of the death certificate of the said Upendranath Saha has already been submitted by the petitioners with the bank authorities.

However, in order to avoid all such complications this Court directs the petitioners to submit duly filled up application form for settlement of claim alongwith declaration/affidavit and indemnity bond in the prescribed format, which has already been supplied to the learned advocate for the petitioners by the learned advocate representing the State Bank of India in course of hearing of this petition. If the petitioners submit the aforesaid documents and comply with all requisite formalities including submission of death certificates of the said Upendranath Saha

and Manju Hazra and pay requisite bank charges, the authorities of State Bank of India shall release the aforesaid articles to the claimants after verifying the identity and entitlement of the claimants as expeditiously as possible but positively within a period of four weeks from the date of submission of the aforesaid documents and compliance of all formalities in that regard.

8. With the aforementioned observation and direction this writ petition is disposed of.

9. Urgent Photostat certified copy of this order, if applied for, be delivered to the learned advocates for the parties, upon compliance of all formalities. (HIRANMAY BHATTACHARYYA, J.)
