1. Affidavit of service filed by the petitioner, let it be taken on record.

2. The present petition has been filed for transfer of maintenance case under Section of Cr.P.C.

by petitioner/husband from the learned Court of Judicial Magistrate, 2nd Court at Malda to the learned Court of Additional Chief Judicial Magistrate at Barasat, North 24-Parganas on the ground of illness.

3. The Court has considered the submissions. The only contention raised by the learned counsel for the petitioner is that the petitioner is suffering from lung disease.

4. Let the learned trial court not insist upon the personal appearance of the petitioner/husband except on the date when his personal appearance is insisted by the Court.

5. With the above observation, the petition stands disposed of.

6. Urgent photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all usual requisite formalities.
