1. The petitioner had participated in the selection process for the post of Anganwadi Workers held in December, 2012. A panel was prepared on 23rd December, 2012 for Chanchal Block-II, ICDS Project.

2. There were four vacancies, three vacancies were duly filled up. The petitioner and another candidate, namely, Aparna Biswas, secured the same marks. The respondents were in a quandary as to who should be given the appointment.

3. The petitioner approached this Court in 2015 by way of a writ petition being W.P. No. 3521 (W) of 2015. A Single Judge of this Court, by an order dated 16th February, 2015, recording that the panel has expired, directed a fresh recruitment process to be conducted for the vacancies.

4. Challenging the selection process by an order dated 7th January, 2014 passed in M.A.T. No. 1945 of 2013 a Division Bench of this Court stayed the Memorandum

dated 14th September, 2012 and Selection Committee for appointment to the post of Anganwadi Workers in Malda District.

5. The aforesaid order of stay stood vacated on 21st January, 2019 when the petitioner in F.M.A. No. 1206 of 2014 stated that she does not wish to press the appeal any further.

6. There is now no impediment on the respondents conducting fresh recruitment process to the post of Anganwadi Workers in Malda District and particularly in Chanchal Block-II, ICDS Project.

7. It is, therefore, directed that the respondents must expeditiously conduct the recruitment process to the post of Anganwadi Workers in the District of Malda. In the event such process is conducted, the petitioner shall be entitled to participate in the same with an appropriate relaxation in age.

8. With the aforesaid directions, the instant writ petition shall stand disposed of.

9. There will be no order as to costs.
