Report filed by the State is also taken on record. Learned advocate appearing on behalf of the petitioner alleges police indulgence in the illegal activities of the private respondents. In fact, the petitioner has booked a flat in the building where the private respondents are making illegal construction. Complaints were made before the police authorities, but were not acted upon.

Learned advocate appearing on behalf of the private respondents denies the allegations.

Learned advocates appearing on behalf of the State as well as KMC submit that this is a municipal matter and the prime relief for the petitioner lies before the municipal authorities.

The petitioner shall be at liberty to ventilate his grievances before the municipal authorities.

No further order need be passed in this regard. However, the police authorities shall keep a sharp vigil at the locale and ensure that no breach of peace takes place.

With these observations, the writ petition is disposed of.
