1. Learned advocate representing the CBI relies upon the instruction forwarded by the Head of Branch, CBI ACB Ranchi signed on 17th March, 2025 clearly mentioning that the subject property was acquired in the name of the father and mother of the accused Bhaskar Saha in 2011 and later on in 2017, the property was passed on in the name of the brother/petitioner (wife of accused) through will. The subject property was acquired out of the proceeds of crime of the case which is pending adjudication before the learned SDJM, Dhanbad.

Charge-sheet has already been filed on 27th September, 2019. The same is at the stage of appearance of accused persons in the trial.

2. As it appears that, the CBI has identified the property as acquired by the proceeds of crime, accordingly, the prayer of the petitioner permitting her to sell/transfer the same, cannot be allowed.

3. It will open for the petitioner to approach the Court where the criminal proceeding is pending for necessary relief, if so advised.

4. The writ petition stands disposed of.

5. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all the requisite formalities.
