Learned advocate for the petitioner submits that the petitioner was compelled to approach the executive magistrate because of the disturbance in the peaceful enjoyment of his property at the behest of the private respondents. In spite of informing the police authorities no action has been taken.

Learned advocate for the State submits that appropriate proceedings under Section 126 as well as under Section 163 of the B.N.S.S. has been drawn for maintaining peace and tranquility.

In view of the inimical relationship existing between the petitioner and the private respondents, I direct the police authority concerned to ensure that no untoward incident results and appropriate steps be taken if there is any tensed situation.

With the aforesaid observations, the writ petition being WPA No. 27388 of 2024 is disposed of.

The report submitted be kept with the record. A copy of the report be handed over to the learned advocate appearing for the petitioner.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
