The petitioner is aggrieved by the fact that the Case No. ACM 622 of 2020 is pending before the learned Judicial Magistrate, 10th Court, Alipore for three years and till date, the interim maintenance application under Section 125 of the Code of Criminal Procedure has not been decided. Learned advocate for the petitioner submits that on several pretext, the case has been stretched and no stone has been unturned at the instance of the husband to delay the proceedings.

I have considered the submissions of the learned advocate and I am of the view that the learned trial court being the learned Judicial Magistrate, 10th Court, Alipore on the next date i.e. on 26.12.2023 (as has been submitted by the learned advocate for the petitioner) takes effort to dispose of the interim maintenance application. If the same is not possible on a single day, the learned trial court would positively pronounce his order in relation to interim maintenance on or before 15.01.2024. The learned trial court would thereafter fix one date in every 45 days for the purposes of the main case so that trial of the case can be taken to its logical conclusion within a reasonable period of time.

With the aforesaid observations, the revisional application being CRR 4461 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
