Report submitted by the learned advocate appearing for the State be also kept with the record. The petitioner under apprehension preferred the present writ petition as the petitioner-Samitee intends to perform Ganga Aarati on 15th November, 2024 at 4.00 P.M. at Kankinara Paper Mill Ganga Ghat.

The learned advocate appearing for the State has submitted a report which reflects that the police authorities have not denied any permission rather police arrangements have been made and effective steps have been taken by the State administration.

The petitioner-Samitee will take abundant precaution in respect of its devotees who will be attending the said Ganga Aarati.

As the local police administration is already aware and had taken adequate steps, the Samitee

would extend their co-operation with the State administration. Names of ten office bearers or volunteers be furnished to the local police administration or the Inspector-in-Charge, Bhatpara Police Station. Communications would be exchanged between the volunteers and the local police administration.

The organisers would ensure that after certain distance, the devotees are not allowed to cross a border line which would be near to the river for safety reasons so that there is no rush at the time when the Aarati is being performed.

As the petitioner-Samitee submits that they had been performing such ritual for the last couple of years, the administration is sufficiently experienced to handle such situation. Adequate police force and adequate measures be taken since the performance of this ritual/Aarati would be taking place near the river.

The programme would be scheduled from 2.30 P.M. and should be concluded by 6.30 P.M. on 15th November, 2024.

With the aforesaid observations, the writ petition being WPA 27367 of 2024 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
