Learned advocate appearing for the petitioner submits that 4.757 Kgs. of Heroin were recovered from 3 accused persons. Petitioner submits that he has been shown to be a bystander and subsequently different plea has been taken by the investigating agency.

Learned advocate further submits that the prosecution has relied upon 11 witnesses and there is no possibility of the trial concluding very soon. As such petitioner may be released on any stringent condition.

Learned advocate appearing for the State opposes the prayer for bail and submits that the search and seizure was videographed, the expert opinion regarding the contraband

seized was filed within time and the grounds of arrest was acknowledged by the present petitioner.

I have considered the factum of the quantity of contraband seized and having regard to the same, I am of the view that the petitioner has failed to overcome the rigors of Section 37 of the NDPS Act.

Accordingly, CRM (NDPS) 1531 of 2025 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
