The petitioners are the parents of the 7th respondent and the 8th respondent is their daughter in law. The petitioners allege that the private respondents who are residing in the house owned by the petitioners have been continuously torturing and assaulting them for which they are unable to reside in their house and have been residing elsewhere. The petitioners seek to return to their house and reside there peacefully. They also seek liberty to take necessary steps under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007.

It appears from the report submitted by the State that the complaint lodged by the petitioners has been registered as FIR and charge sheet has been submitted upon completion of investigation. However, since the petitioners intend to return to their own house, the Officer in Charge of Jharkhali Coastal Police Station being the 6th respondent herein is directed to render necessary assistance to the petitioners in order to enable them to return to their house and stay there peacefully without any disturbance from any corner whatsoever. The petitioners shall approach the 6th

respondent indicating their intended date and time of return. The 6th respondent shall render necessary assistance accordingly. In the event the ground floor of the house which is usually occupied by the petitioners is found under lock and key, the police authority shall break open the lock and key and allow the petitioners to enter the said floor. The 6th respondent shall depute a police personnel who shall visit the house of the petitioners every alternate day for the next two weeks to assess whether any cruelty is being meted out by the petitioners.

The petitioners are at liberty to approach the appropriate forum under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007.

The writ petition is disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
