Ms. Bursa Khatun ..for the petitioners Mr. Arka Kumar Nag Mr. Manish Biswas ..for the State The petitioners claim to be the owner of Dag Nos. 654, 656, 657 and 658 within Mouza Samanti under Police Station Panchla in the District of Howrah. The petitioners further claim that adjacent to the aforesaid property of the petitioners the plot owned by the private respondent is situated. The petitioners and the private respondent share a common boundary and common passage with the petitioners and other villagers. The petitioners allege that the private respondent has started illegal construction by encroaching upon the property of the petitioners.

State is represented by its learned advocate. The petitioners have alleged encroachment of an immovable property by the private respondent. Such a dispute cannot be decided in a writ petition. Faced with such situation, the learned advocate appearing for the petitioners prays for leave to withdraw

this writ petition with liberty to approach the appropriate forum in accordance with law.

In the light of the submissions made by the learned advocate for the petitioners, WPA 27042 of 2025 stands dismissed as with withdrawn with liberty to the petitioners to approach the appropriate forum in accordance with law.
