Rakib (Allowed) CRM (M) 2515 of 2025 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Panskura Police Station case no. 735 of 2025 dated 09.08.2025 under Sections 329(3)/74/75/76 of the Bharatiya Nyaya Sanhita, 2023 read with Section 12/8 of the POCSO Act.

Report submitted by the State be kept with the record. Learned advocate appearing for the petitioner submits that the petitioner has been implicated in connection with the instant case on grounds of previous rivalry and is detained for four and half months.

Learned advocate for the State has produced the Case Diary and drawn the attention of the Court to the relevant statements and opposes the prayer for bail.

I have taken into account the statement of the victim under Section 183 of the BNSS. Having considered the period of detention of the present petitioner, I am of the opinion that

further custodial detention is unwarranted. As such the prayer for bail of the petitioner is allowed.

Accordingly, petitioner namely, Sk. Akbar shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court under POCSO Act, Tamluk, Purba Medinipur.

If on bail, the petitioner shall stay outside the jurisdiction of Panskura Police Station and shall enter the jurisdiction for the limited purpose of meeting with the Officerin-Charge once in a week till further orders of this Court. Petitioner, if he intends to go outside the jurisdiction of district Purba Medinipur he will seek permission of the learned Special and shall not leave the jurisdction without informing the Court.

Accordingly, the application for bail being CRM (M) No. 2515 of 2025 is allowed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
