Rakib (rejected) CRM (M) 2516 of 2025 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Arambagh Police Station case no. 405 of 2025 dated 01.08.2025 under Sections 352 of the Bharatiya Nyaya Sanhita, 2023 and under Section 6(1) of the POCSO Act.

Learned advocate appearing for the petitioner submitted that the petitioner is in custody for 90 days and charge-sheet has already been submitted before the jurisdictional Court, as such on any condition petitioner may be released on bail. Learned advocate for the State has produced the Case Diary, drawn the attention of the Court to the statement of the victim before the learned Judicial Magistrate as also the medical report.

Having considered the same, I am not inclined to release the petitioner on bail.

Accordingly, CRM (M) 2516 of 2025 is dismissed. Petitioner would renew his prayer for bail after the examination of the victim is over.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
