An order dated October 28, 2025 passed by the Chairman, West Bengal Central School Service Commission (Annexure P9, p.31) rejecting the petitioner's prayer for extending the validity period of recommendation letter is impugned in the instant writ petition.

It appears that the petitioner was working in a school prior to her accepting appointment in terms of the recommendation made in 1st SLST 2016. As the petitioner lost the job which she got under the 1st SLST, in view of the judgment passed by the Hon'ble Supreme Court in Civil Appeal No.4800/2024 [State of West Bengal -vsBaishakhi Bhattacharya (Chatterjee) & Ors.] on April 3, 2025, she approached the Court for extending the validity period for joining in terms of the recommendation letter issued in her favour by the Commission.

Several similar matters were dealt with by the Court and upon hearing the submissions made on behalf of the petitioners and the Commission, the Court passed an order on December 9, 2025 in WPA No.22282 of 2025 (Shankar Prosad Halder -vs- The State of West Bengal & Ors.) which is relied upon by the petitioner.

As the facts of the instant case are similar to the one of Shankar Prosad Halder (supra), similar direction is being passed herein.

The Commission is hereby directed to recommend the petitioner subject to availability of matching vacancies only after completion of the process of filling up 1242 vacancies.

The aforesaid order is being passed keeping in mind the order passed by the Hon'ble Division Bench of this Court on November 25, 2025 in MAT No.1512 of 2025 with I.A. No. CAN 1 of 2025 (West Bengal Central School Service Commission & Anr. -vs- Arpita Pramanik & Ors.) wherein the Hon'ble Division Bench took note of the fact that the candidate was empanelled and came within the listed vacancies of the Commission but as the candidate was absent in the process of counseling, the recommendation letter lapsed. 7.

The impugned letter of rejection dated October 28, 2025 stands set aside.

The writ petition stands disposed of.
