The petitioners' prayer for mutation is pending consideration at the end of the Garulia Municipality. Learned advocate representing the Municipality submits, upon instruction that, there were discrepancies in the description of the property as submitted in the application and the chain deed. The petitioners were intimated to provide necessary documents to process the application for mutation.

From the documents annexed to the writ petition and the submissions made on behalf of both the parties the present writ petition is disposed of by directing the Municipality to intimate in writing the deficiencies in the application for mutation filed by the petitioners. The petitioners will be obliged to rectify the defects and give proper description of the property so that their application for mutation can be processed by the Municipality.

Learned advocate for the petitioners is directed to forward a copy of the application for mutation, documents showing submission of mutation fees, the chain deed and all other necessary documents in relation to the subject property to the Municipality at the earliest.

The Municipality upon consideration of the aforesaid documents shall intimate the petitioners the formalities to be complied for processing the application for mutation.

The Municipality shall take steps to conclude the matter at the earliest but positively within a period of twelve weeks from the date of receipt of all the documents from the petitioners.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
