This revisional application has been preferred by the petitioner being dissatisfied with the manner in which the interim order was obtained in connection with Criminal Revision No. 11 of 2023 from the court of the learned Additional Sessions Judge, 1st Court, Asansol. It has been submitted by the learned advocate appearing for the petitioner that the petitioner was never served with the revisional application, but was only served after the stay was obtained and when there was an order by the court in seisin of the execution case.

As the revisional application is still pending before the jurisdictional sessions court, I am restraining myself to comment with the manner in which the interim order has been obtained. However, I direct the learned revisional court to dispose of the revisional application on 22.12.2023. In case any impediment is created for reasons beyond control, the learned revisional court will direct that the stay would continue subject to payment of Rs.6000/- as directed by the learned trial court.

All efforts be taken to conclude the revisional application on 22.12.2023, if not possible, by 10.01.2024.

With the aforesaid observations, the revisional application being CRR 4469 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
