(NDPS) 1802 of 2024 In Re: - An application for bail under Section 439 of the Code of Criminal Procedure as amended /under Section 483 of the Bharatiya Nagarik Surksha Sanhita, 2023, in connection with Jibantala Police Station Case No.401 of 2018 dated 07.09.2018 under Sections 21(c)/24/29 and adding Sections 20(b)(ii)(c)/29 of the Narcotic Drugs and Psychotropic Substances Act.

1. We have heard learned counsel for the parties.
2. Petitioner is in custody for 5 years. On the score of delay, coaccused has been enlarged on bail. Petitioner is entitled to similar relief.
3. Learned counsel for the State opposes the bail prayer.
4. Accordingly, we direct the petitioner namely, Rintu Khan @ Md. Rentu Khan shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Judge, Special Court (under NDPS Act), Alipore, South 24-Parganas, subject to the condition that the petitioner shall appear before the trial court on each and every date of hearing until further orders and shall not intimidate witnesses and/or tamper with evidence in any manner whatsoever and on further condition that the petitioner while on bail shall remain with the Jibantala police station except for court proceeding and report to the officer in charge of Jibantala police station once in a week until further orders. 5. In the event petitioner fails to appear before the Trial Court without any justifiable cause, the Trial Court shall be at liberty to cancel his bail without any further reference to this Court.
