Learned senior counsel appearing for the alleged contemnor, appears upon notice and submits that there was no deliberate intention on the part of the alleged contemnor to flout the order of this court willfully. In fact, the application for transfer to the Bar Council of India, which gave rise to the alleged contumacious act, was filed a day prior to the order of this court.

Learned senior counsel appearing for the petitioner controverts such contention and submits that even after the order was passed by this court, the application was moved and argued before the Bar Council on the part of the alleged contemnor.

Since the alleged contemnor seeks to refute the contempt application on certain questions of fact as well, the alleged contemnor is directed to file affidavit-in-opposition within three weeks from date; reply, if any, shall be filed within a week thereafter.

The contempt application shall be listed on March 15, 2024 for hearing.
