By filing this public interest litigation the petitioners allege illegal construction put up by the private respondents. Earlier, a writ petition was filed by one Sushanta Barik, being WPA No.22249 of 2019, alleging that the private respondents therein have raised construction in front of a village road situated at LR Plot No.3850 of Mouza-Panchla. The writ petition was disposed of by issuing following direction.

"Without going into the merits of the allegations of the petitioner, the writ petition is disposed of with a direction upon the Panchla Gram Panchayat to dispose of the said representation and to take steps in terms of Section 25(2) of the West Bengal Panchayat

Act, 1973, upon holding an inspection in the presence of all the parties including the respondent nos.8 to 10 and upon granting an opportunity of hearing to them."

As the Hon'ble writ Court has already issued direction, it is for the authority to comply with the direction in its letter and sprit and while doing so the authority concerned shall also consider the petitioners' representation.

With the aforesaid observation, this writ petition is disposed of.
