...For the Petitioners The present revisional application has been preferred praying for expeditious disposal of the application under Order 39 Rule 1 and 2 of C.P.C. in title Suit No.383 of 2022 pending before the learned Civil Judge (Junior Division), 1st Court, Barasat. It is submitted that an interim order was passed on 12th April, 2022, but till date said application has not been disposed of finally and as such the defendants in the suit, who are the petitioners herein, are being prejudiced.
Considering the nature of relief prayed for, the learned trial court is directed to dispose of the application under Order 39 Rule 1 and 2 of C.P.C., by giving opportunity to both the parties, preferably within a period of two months of passing this order. With the aforesaid direction, the revisional application is disposed of.
Connected applications, if any, stand disposed of.
Urgent Photostat certified copy of this order, if applied for, be given to the parties, on priority basis, upon compliance of all necessary formalities. There will be no order as to costs.
