Affidavit of service filed on behalf of the petitioner is taken on record.

By the present writ petition, the petitioner seeks for direction upon the respondent authorities for his transfer to a school nearby his residence.

The petitioner contends that he is an Assistant Teacher at Dhankhali F. P. School under Kultali Circle, South 24 Parganas. The petitioner has joined the said school on 14th February, 2017. The petitioner has been confirmed in the service. The petitioner has been suffering from various ailments, particularly, severe orthopedic problems relating to knee, due to an accident caused on 29th November, 2019. On 2nd September, 2024, the petitioner made a representation before respondent no. 5,

the Chairman, District Primary School Council, South 24 Parganas and other authorities as well seeking for his transfer. However, the same is still pending consideration. Hence this writ petition.

Mr. Atreya Chakraborti, learned advocate appearing for the petitioner submits that the matter be relegated to the appropriate authority for consideration of his representation.

Mr. Ratul Biswas, learned advocate appearing for the respondent Board and Mr. B. P. Vaisya, learned advocate appearing for the DPSC, South 24 Parganas also submit that the matter be sent to the appropriate authority for due consideration.

In view of the submissions advanced by the respective parties, respondent no. 5, the Chairman, District Primary School Council, South 24 Parganas is directed to consider the representation of the petitioner dated 2nd September, 2024 and dispose of the same by passing a reasoned order in accordance with law upon notice to the petitioner within a period of eight weeks from the date of communication of this order.

The reasoned shall be communicated to the petitioner within a week of passing thereof.

Respondent no.5 shall be at liberty to seek for medical examination of the petitioner before considering such representation, if so required.

The petitioner is directed to communicate this order to respondent no. 5, the Chairman, District Primary School Council, South 24 Parganas for necessary compliance. 10.

With the above directions, the writ petition being no. WPA 27154 of 2025 stands disposed of.

Since no affidavits have been called for, the allegations made in the writ petition are deemed to be not admitted. 12.

Consequently, connected applications, if any, also stand disposed of.

13.

Interim orders, if any, stand vacated.

14.

There will be no order as to costs.

15.

Urgent certified photostat copy of this order, if applied for, shall be given to the parties as expeditiously as possible on compliance of all necessary formalities. (Bivas Pattanayak, J.)
