Mr. Sur, learned counsel appears for the petitioners.

Mr. De, learned State-counsel with Mr. Bari, learned State-counsel, appears for the respondents. The land of the petitioners has been utilized by the State authorities for public purpose without acquisition. The State has adopted Direct Purchase Policy in respect of the land of the petitioners. Referring to page 34 to the writ petition, learned counsel for the petitioners, submits demarcation process has been initiated by the appropriate State authority in aid of the execution of the Direct Purchase Policy.

In view of the above, the respondent no. 7 shall conclude all the formalities including making of payment to the price after the direct purchase will happen by the State authority upon compliance of legal formalities strictly and in accordance with law within a period of six months from the date of communication of this order. It is made clear that the compensation should be ascertained strictly in accordance with law and paid to the petitioners following the law if they are entitled to receive the same in law within the aforesaid timeframe.

Since affidavits are not called for, allegations made in this writ petition are deemed not to have been admitted by the respondents.

With the above observations and directions this writ petition WPA 27499 of 2024 stands disposed of, without any order as to costs.
