Kausik (Rejected) CRM (M) 2594 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Malda Police Station Case No. 104 of 2024 dated 23.02.2024 under Sections 302/201/34 of the Indian Penal Code and under Section 6 of the POCSO Act, 2012.

Report submitted by the State be kept with the record. Petitioner submits that he is in custody for more than 1 year and 10 months and there is no possibility of the trial concluding in near future as only 3 witnesses out of the cited 33 witnesses till date has been examined by the prosecution. Having considered that the merits of the case do not favour the petitioner to be released on bail, I hold that CRM (M) 2594 of 2025 be dismissed at this stage.

The learned Trial Court is directed to obtain a list of vulnerable witnesses and complete the examination of the same by 31.05.2026.

Petitioner would renew his prayer for bail after the aforesaid stage is over.

Learned advocate for the State will communicate this order through the Investigating Officer so that the same be placed before the learned Trial Court for appropriate action. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
