The petitioners claim that their land has been forcibly occupied and entered into by the private respondents.

There are some disputes as regards the existence of the land. Counsel for the private respondents submits that during the rainy season the land is covered by the river Padma. It is, in fact, located in the riverbed. The petitioners want the police to ascertain the title of the land.

This Court is of the view that police have no role to play in ascertaining the title of the land. The petitioners may take out civil proceedings in accordance with law against the private respondents in this regard. With the aforesaid observations, the writ petition shall stand disposed of.

There shall be no order as to costs.
